US Court Mandates Freedom of Kilmar Abrego Garcia from ICE Custody
A federal judge has ordered the immediate discharge of Kilmar Abrego Garcia from immigration custody, concluding his ongoing confinement is without lawful basis.
"Since Abrego Garcia's release after erroneous imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her order.
The case stems from a erroneous deportation to El Salvador earlier this year, which US authorities later admitted was an mistake. After his repatriation to the United States to answer alien smuggling allegations, he was held in immigration detention.
In her order, the judge noted that the authorities does not have a current deportation order, which effectively blocks them from removing Mr. Abrego Garcia "at this time."

The legal challenge involve conflicting claims. Whereas the former administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he categorically disputes this claim.
