New Jersey's top prosecutor steps down following court disqualifies her service.
Alina Habba has resigned as the chief federal prosecutor in the state. This comes after a judicial decision that invalidated her eligibility to hold the office.
Attorney General's Statement
US Attorney General, Pam Bondi, confirmed the prosecutor's departure on Monday. Bondi stated that the appeals court finding made it "untenable" for her to effectively run her office.
"But do not mistake adherence to the ruling as defeat," she declared. "The effort will now extend throughout the country."
Court Ruling
The departure follows closely on a judicial panel ruled that she had been unlawfully serving as the top prosecutor. This ruling is expected to impact many prosecutions in the state.
The court declared that a temporary posting that skirted the advice and consent of the Senate ran afoul of the Federal Vacancies Reform Act.
Future Role and Reaction
Bondi said that Habba will continue working within the Department of Justice as a top consultant. They intend to challenge the decision of the disqualification, aiming for a different outcome.
Writing online, the Attorney General contended that the judiciary "must not override the President's choice of prosecutors entrusted with performing the executive branch's core responsibility of prosecuting crime."
Accomplishments Cited
She commended her tenure and noted that under her leadership, the state capital of Newark saw a one-fifth decrease in criminal activity. She also stated that the city of Camden recorded its first summer in half a century with no murders.
Connection to Donald Trump
Habba, first joined the former president's legal defense in recent years. Subsequently, she acted for Trump in his New York criminal case in 2024, which resulted in his guilty verdict on dozens of charges of financial record manipulation.
Earlier, Habba took on the role of US Attorney, the former president had announced he was selecting her as his presidential counsellor in a potential future term, labeling the lawyer as "unwavering in her loyalty" and a relentless legal advocate.
